1.- GENERAL PROVISIONS
1.1 These Terms of Purchase, govern the conditions of purchase of products purchased by the Customer on the trading platform of the web www.colonogourmet.com, being the employer for legal purposes:
- If you contract in Spain, Prophit Place, S.L. with CIF. B19602135 and registered office at Calle Imprenta, 2, Granada, 18010, Granada, registered in the Granada Trade Register, Volume 1587, book 0, page 31, section 8 with page GR 48177.
- If you contract in any other country of the European Union, Colono Gourmet GmbH, FN 484520f, and head office in Landstraßer Hauptstraße 6, 1030 Vienna, Austria.
Both entities are hereinafter referred to as "COLONO".
In accordance with the legislation in force, "Consumer" shall mean any natural person acting for a purpose unrelated to his or her trade, business, craft or profession.
1.2 COLONO reserves the right to select at any moment the products offered. Thus, COLONO may add new products to the platform and all these new products will be regulated in accordance with the applicable terms and conditions.
COLONO reserves the right to interrupt at any time without prior notice access to the offered products of the platform.
2.- HOW TO BUY IN COLONO?
2.1 To buy the products of the platform, you must follow the instructions on screen and accept the purchase. The purchase means that the customer accepts the terms and conditions, the privacy policy, the conditions of purchase and return. These conditions are available by clicking on the corresponding link.
2.2 If the customer has selected the product he wants to buy, he can add it to the cart by clicking on the button [Cart - Add to cart]. If it is clear, in many cases you can add them directly from the category to make a more agile purchase. If you want to add more than one unit, click on the button [Basket - Add to cart] as many times as you want to purchase.
Any selected item can be removed from the cart before payment.
In the upper right corner you will have the cart showing the total amount of the current order. If you click on it, you will be shown the cart, you can also click on it to be redirected to the list of products you want to buy.
Once you have reviewed (and edited if necessary) the final list you can also add any comments you deem appropriate about the order. Possible management and shipping costs are not included, their amount will be indicated at the time of final confirmation of each order.
Once this process has been completed, click on [Process order] to access the purchase process.
2.3. If you are already registered, you must enter your user name and password; if you are not, register or fill in the fields that appear as obligatory. After entering the requested information, the customer can verify that the data are correct and can correct, if necessary, those containing errors. You can also finish the purchase directly with "Paypal Express". If you have a discount code, it is time to enter it in the corresponding field.
2.4. To complete the purchase, you must confirm the order. Click on the button [Continue shipping], select the shipping option that best suits your needs. Click on the button [Continue to pay].
2.5. Payments for the selected products can be made by bank transfer, credit card, Paypal or Sofort. Fill in the billing address and click on the button [Consult order].
2.6. Finish the order by clicking on the [Buy] button. Depending on the payment method you have chosen, (for example, in the case of Paypal or Sofort), you will be redirected to websites owned by payment service providers to complete the transaction.
2.7 Both the order information and the Terms of Purchase are included in the order confirmation we send you by email, and can be easily printed or saved with your email. You can also download the Terms of Purchase independently by accessing the link provided and using the browser commands to save the document.
3.- AVAILABILITY
The product offers and prices are valid while they are displayed on the website www.colonogourmet.com and always depending on the available stock.
Within this framework, indications on the availability of products will be provided at the time each order is processed.
If a product is not available after the order has been placed, we will inform you as soon as possible. At that time you will be able to modify your order or cancel it.
The customer will receive a full or partial refund of his order within 30 days of placing the order.

5.- CANCELLATION AND RETURN
COLONO reserves the right to cancel an order received, either in part or in full, in the following cases:
* If the product ordered is not in stock.
* If full payment of the order is not received or if payment fails in any part of the process.
* If the order does not comply with these Terms and Conditions of Purchase.
6.- LEGAL RIGHT OF WITHDRAWAL
In case the customer has the condition of Consumer, the customer has the right to cancel or return his order according to the following conditions:
6.1 Return period
In accordance with current regulations, you have 14 days from receipt to return your order without the need for any justification.
To exercise the right of withdrawal, you must notify us at info@colonogourmet.com by means of an unequivocal statement. You may use the model withdrawal form below, although its use is not obligatory.
The right of withdrawal does not apply to products that have been processed in accordance with your instructions, nor to fresh products or products with an expiry date that is less than or equal to the date on which you inform us of the withdrawal.
6.2 Condition of the product to be returned
COLONO can only refund products received in their original condition, with seals and packaging intact and without any other manipulation.
COLONO determines whether the products are in the same condition as they were sent to you. We will make a check of the returned products to confirm that they arrive in optimum condition before proceeding to reimburse the amounts, the shipping costs being non-refundable.
We will not accept returns of products that do not come in their original packaging or with a broken seal, unless they are defective products.
6.3 Consequences of withdrawal
The products must be returned or delivered no later than 14 days from the date you inform us of your decision to withdraw.
The deadline will be deemed to have been met if you return the goods before the 14-day deadline has expired. You are only obliged to cover depreciation in the value of the goods if the depreciation is the result of improper handling of the goods when examining their condition, properties and functioning.
In the event of withdrawal, we will refund any payments you have made, including shipping costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method that we offer) without any undue delay and in any event within 14 days from the date on which we have been informed of your decision to withdraw from this contract. The refund will be made using the same payment method you used for the initial transaction, unless otherwise expressly agreed. We will not charge you any fees as a result of the refund. We may withhold the refund until we have received the goods, or until you have provided proof of return of the goods, whichever is the earlier.
COLONO does not bear the costs of returning the goods.

7.- WHAT HAPPENS IF YOU RECEIVE A WRONG OR DEFECTIVE ORDER?
In this case, please contact us within 24 hours of receiving the order through info@colonogourmet.com indicating the error or defect along with your personal data.
We will proceed to make the return or replacement (if any) as soon as possible within 30 days after you receive our confirmation email.
The amounts paid for those products that are returned due to a tare or defect will be fully reimbursed in the same way as the payment was made, including the delivery costs that you have previously paid and the costs of sending the return.
If the error is due to transport, or the packaging does not arrive in good condition, it must be noted on the delivery note that the carrier will make you sign.
8.- SALE OF ALCOHOLIC BEVERAGES
The sale of alcoholic beverages to persons under the age of 18 is prohibited.
For this purpose, the customer declares to be an adult (18 years or older) and capable of contracting by accepting the Terms of Purchase. Acceptance of the Terms of Purchase is required when making a purchase and at www.colonogourmet.com.
In case of doubt, COLONO reserves the right to request a copy of a valid identification document.
9.- CHANGES TO THE CONDITIONS
9.1 The information appearing on WWW.COLONOGOURMET.COM is that in effect on the date of its last update. COLONO reserves the right to update, modify or delete information on this website.
9.2 COLONO reserves the right to unilaterally modify the Terms of Purchase, as well as the conditions and terms of use of this website. Any modification of these will be announced accordingly. The entry into force of the modifications to the conditions of use will take place from the moment of their publication on this website.
10.- APPLICABLE LAW AND JURISDICTION
10.1 This contract shall be governed by Spanish law, which shall apply to all matters not provided for in this contract with respect to its interpretation, validity and performance.
10.2 In general, they will be competent to hear disputes:
- If you contract with Prophit Place, S.L., the courts of the city of Granada.
- If you contract with Colono Gourmet GmbH, the courts of Vienna.
10.3 If the Customer is a consumer, the relevant courts shall be competent in accordance with current consumer legislation.
10.4 Furthermore, the European Commission has an online platform for the resolution of legal disputes, which is available at the following link: https://ec.europa.eu/consumers/odr/. You may file complaints through the above-mentioned online platform for the resolution of legal disputes.
